1. DEFINITIONS

All terms relating to the protection of personal data used in this policy and identified by capital letters, whether used in the singular or plural, shall be interpreted in accordance with General Data Protection Regulation 2016/679 of 27 April 2016 repealing Directive 95/46/EC (hereinafter "GDPR").

Processing: any operation or set of operations performed on personal data or sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction. The purposes of processing implemented by Schmoove are identified in Article 5 of this policy.

Data Controller: the natural or legal person, public authority, agency, or other body which, alone or jointly with others, determines the purposes and means of the Processing. For example, when browsing our website or accessing our services, your data are processed by Schmoove as Data Controller.

Processor: a natural or legal person, public authority, agency, or other body which processes Personal Data on behalf of the Controller.

Recipient: a natural or legal person, public authority, agency, or another body to which the Personal Data are disclosed, whether a third party to Schmoove or not.

3. COLLECTION OF YOUR PERSONAL DATA

  • When you contact us by telephone, post, or email, or through a contact form: we collect all Personal Data you transmit to us, such as your surname, first name, postal or email address, telephone number, etc., as well as any information provided by you in your contact request and, where applicable, the content of the message, along with any information subsequently communicated during your interactions with Schmoove.
  • When you subscribe to our services: we collect all Personal Data necessary for creating and managing your customer account as part of executing the contract entered into with us, such as surname, first name, postal address, email, telephone number, banking details, etc.
  • When browsing the website: we may collect data such as browser types and versions used, the operating system used by the accessing system, the website from which a system accesses our website, the sub-pages accessed via a system on our website, the date and time of access, an Internet Protocol address (IP address), the Internet service provider of the accessing system, and other similar data and information used for risk prevention in case of attacks on our IT systems.
  • When managing your order, Schmoove collects data relating to order processing and invoicing. In this context, we process data such as your surname, first name, email address, postal address, telephone number, and payment details.
  • In commercial prospecting, loyalty initiatives, surveys, product testing, promotional activities, and the organization of contests or lotteries, Schmoove may collect your identification data, such as your surname, first name, and email address.
  • When compiling commercial statistics, Schmoove may collect data related to your order history, connection and browsing data, and purchase frequency.

Schmoove ensures that the collection of your Personal Data is relevant, adequate, non-excessive, and strictly necessary for its activities.

You are informed that certain information is essential to benefit from our services (for example, when filling out a form, mandatory fields are marked with an asterisk). Failing to provide this information means we will be unable to provide the relevant services.

4. PURPOSES AND LEGAL BASIS FOR DATA PROCESSING

We process personal data within the scope of services offered by Schmoove to fulfill the purposes listed below:

  • Creation and management of your customer account, as well as the provision of our services. The legal basis for processing is the performance of the contract entered into with Schmoove.
  • Management of claims and requests for information sent to our services. The legal basis for processing is either the performance of the contract when you have subscribed to our services, or our legitimate interest in replying and communicating with you.
  • Carrying out commercial prospecting activities. The legal basis for processing is your consent when you are a consumer. In all cases, you may object to receiving marketing communications from us.
  • Carrying out promotional events such as contests and lotteries is legally based on your consent.
  • Elaboration of statistics or surveys. These are carried out using anonymized data to improve our understanding of our business and customers. In this context, the legal basis is Schmoove’s legitimate interest.
  • Compliance with our legal obligations, such as combating fraud and, more generally, managing any unlawful activities.
  • Improvement of our website and adaptation of its content to meet user needs, with your consent.

5. RETENTION PERIOD FOR PERSONAL DATA

Schmoove retains your Personal Data for the duration necessary to achieve the purposes for which they are processed. They may also be retained to satisfy a legal obligation or if they present an administrative interest for a period determined according to that interest.

By way of example, the following retention periods are applied by Schmoove:

  • All personal data collected from the user/customer will be kept for the duration of the commercial relationship and for a period of 3 years following the end of said commercial relationship (for example, from the date of your last purchase).
  • When you have consented to receive commercial prospecting by email, we retain your Personal Data until you object via the unsubscribe link or express request; in any event, your data will be deleted 3 years after the last contact initiated by you.
  • All personal data collected from a prospect will be kept for 3 years from their collection or from the last contact initiated by the prospect (e.g., product information request, clicking a link in an email sent by the seller).
  • When you contact us via the contact form, post, email, or telephone, we retain your Personal Data for the time necessary to process your request.
  • When you create an account on the website, your Personal Data are retained for the duration of account use and, unless you object, deleted after 3 years without logging in. You may request the deletion of your personal account at any time.
  • When you submit a job application to Schmoove, your Personal Data are retained for the duration required to evaluate your file. If rejected, your data are deleted 2 years after the refusal decision, unless you object. If hired, your Personal Data are retained for the duration of your employment contract.

6. DATA RECIPIENTS

Your Personal Data are intended solely for Schmoove and are accessible only to authorized staff members according to the purposes of collection and within the limits of their respective duties.

By way of exception, your Personal Data may be communicated to third parties when we rely on technical service providers acting on our behalf and according to our instructions (carriers, server hosts, etc.).

These service providers are authorized to process your Personal Data only to the extent necessary to provide services on our behalf or to comply with legal requirements.

Under no circumstances are your Personal Data communicated to Schmoove’s commercial partners without your explicit consent.

Schmoove may also be required to disclose your Personal Data to third parties when such disclosure is required by law, a regulatory provision, or a court order, or if necessary to protect and defend our rights.

7. INTERNATIONAL DATA TRANSFERS

Within the scope of service contracts concluded by Schmoove, recipients of Personal Data may be located abroad, including outside the European Economic Area (EEA) in countries where personal data protection laws differ from those applicable within the EEA.

Any transfer of data outside the EEA is carried out subject to appropriate safeguards, particularly contractual guarantees, in compliance with applicable data protection regulations.

8. SECURITY MEASURES

Schmoove undertakes to protect your Personal Data against loss, destruction, alteration, unauthorized access, or disclosure. To this end, Schmoove implements appropriate technical and organizational measures, considering the nature of the data and the risks involved in processing, to preserve the security and confidentiality of your Personal Data.

These measures may include restricted access to Personal Data for Schmoove employees, contractual guarantees when using external service providers, privacy impact assessments, regular reviews of procedures on IT systems, and physical/logical security measures (secured access, authentication procedures, backups, antivirus software, firewalls, etc.).

9. COOKIE MANAGEMENT

A "cookie" is a small file, usually composed of letters and numbers, sent by the web server to the browser’s cookie file on your computer's hard drive. RESTRICT PROCESSING: obtain from Schmoove the restriction of processing for a specified period based on grounds listed in Article 18 of the GDPR.

DATA PORTABILITY: receive the Personal Data concerning you that you provided to Schmoove in a structured, commonly used, and machine-readable format, and transmit those data to another controller.

OBJECT: request that Schmoove no longer process your Personal Data on grounds relating to your particular situation, or without justification in cases of commercial prospecting.

NOT BE SUBJECT TO AUTOMATED DECISION-MAKING: not be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.

WITHDRAW CONSENT: withdraw your consent to the processing of your Personal Data by Schmoove at any time.
